Note to Ontario Government - There is no “fairness” in “transparency” when it comes to Metrolinx contract, says CAW Local 103

North Bay - Recent media reports from around the province quoting the Nipissing MPP, the Minister of Transportation and the Minister of Northern Development that they will not reverse the awarding of the GO Transit Refurbishment contract to CAD Rail contending that it was done in a “fair and transparent tendering process” is beginning to wear thin on community leaders and ONTC employees.

CAW Local 103 is questioning why then, is Metrolinx further delaying the release of information requested by Local Union Vice President  Andy Mitchell,  under  the Freedom of Information and Protection of Privacy Act  request filed back on July 6th and are now wondering what the real reasons are for the delay.

“Metrolinx announced on July 14, 2011 that they would be awarding a $120M refurbishing contract to CAD Rail located in Montreal PQ solely on the “lowest price” basis. It has since been disclosed by Metrolinx that they awarded the contract without even viewing the site to determine if CAD Rail has the physical capacity or even the skills necessary to perform the work” said Local Union President Brian Kelly. In a letter dated August 12th to Mr. Mitchell, Metrolinx stated that they needed to extend the release of the requested information to October 25th, because of the size of the request could interfere with the operations of Metrolinx and their need to consult with “third parties” about the release of the information.

 “The McGuinty government has stated categorically in defense of their approval in awarding this contract to CAD Rail that the bidding process was “fair and transparent”. Mr. Mitchell made his request 6 weeks ago and now Metrolinx is saying they need another 2 months to go and find the files they relied on to make the decision. If this process was fair and transparent, then meeting our request for information is straight forward”, added Kelly.

“This government’s repetitious verse of “fair and transparent process” is sounding more and more like excuses for an indefensible decision. We know of no understandable reason why someone at Metrolinx can’t simply pull the file folder marked “CAD Rail Deal” and forward the requested information.  Metrolinx’s insistence on further delaying the release until they have consulted with “third parties” makes us wonder what is really going on with this tendering process which will cost Ontario taxpayers more than $8M”, concluded Kelly.

Five More to GO then what? asks CAW

North Bay – The GO Transit refurbishment contract that was awarded to Ontario Northland in 2004 is coming to a projected end, on-time and on-target with the remaining GO Transit coaches being delivered to Metrolinx in the coming weeks.

“With the delivery of the next GO Transit coach slated for August 15th, we’ll have only 5 GO coaches left in our facilities, the equivalent of 10 more weeks of work. Our members and the community at large are asking what’s happens after the GO Transit and recently announced Polar Bear Express work dries up?” said Brian Kelly, President of CAW Local 103.

Metrolinx announced on July 14, 2011 that they would be awarding a $120M refurbishing contract to CAD rail located in Montreal PQ solely on the “lowest price” basis. It has since been disclosed by Metrolinx that they awarded the contract without even viewing the site to determine if CAD has the physical capacity or even the skills necessary to perform the work.

“We are still at a lost to understand, given the increasing tide of frustration with the government from across the entire North why the Premier refuses to take a leadership role and intervene. Premier McGuinty must stop this deal and award the project to the ONTC”, continued Kelly.

“We find it interesting that Transportation Minister Kathleen Wynne can pick up the phone and tell Metrolinx CEO Bruce McCuaig to cancel a contract for art work as she did today on the new Eglinton LRT line but the Premier steadfastly refuses do the same thing with the Metrolinx deal with CAD”, added Kelly.

“This decision can be overturned by The Premier and it must be overturned. This contract is too important to the communities and people who work at and are serviced by the ONTC. We are not going away”, concluded Kelly.

CAW Local 103 Takes Metrolinx Campaign To Toronto’s Largest Newspaper

North Bay – CAW Local 103 announced today that it will be placing ads in the Toronto Star newspaper the country’s largest circulated paper in continuance of the multi stakeholder campaign to have the Ontario Government reverse the Metrolinx boards decision to award the GO Transit Rail Coach Refurbishment contract to Canadian Allied Diesel (CAD) of Montreal.

“We believe it is the next step in our long term campaign to overturn the Metrolinx decision to build support in the Greater Toronto area”, said CAW Local 103 President Brian Kelly.

“Once people are informed of the facts surrounding the awarding of the contract to CAD instead of Ontario Northland people are fully supportive and will contact Premier McGuinty’s office to tell him to reverse this decision”, continued Kelly.

Premier McGuinty: Please Stop Sending Our Taxes and Jobs out of Province

On June 24, 2011 the Board of Metrolinx’s announced that a 5 year government contract in the neighbourhood of $120M to refurbish 121 GO Transit Rail Coaches would be awarded to a Montreal firm, Canadian Allied Diesel (CAD). Metrolinx’s decision was based solely on CAD being the lowest bidder by about a total of $2 Million.

Metrolinx may be saving $2 million but Ontario Taxpayers will lose over $8 million and 110 jobs will be sent to Quebec. The loss of jobs in Northern Ontario could be devastating to many communities. The Government is willing to lose $8M to save $2M.

The 110 workers employed by the Ontario Northland Transportation Commission in North Bay on the current GO Transit contract take great pride in their work including the fact you can’t tell the difference between a refurbished coach to a new one. You may be riding in one of those refurbished GO Transit coaches at this very moment. If Metrolinx gets their way those 110 jobs and your taxes will go to Montreal to save $2 million and we will lose $8 million.

Mr. Premier the math does not add up! Please reverse the decision for the benefit of all Ontarians. If the Premier of Ontario won’t stand up for Ontario taxpayers, communities and workers who will?

CAW Local 103, Northern Mayors and Business leaders contend that this new contract should be awarded to Ontario Northland and that the Ontario Government needs to intervene and reverse this decision.

ONTC Workers Angered by Metrolinx signing of Deal with CAD

North Bay – CAW Local 103 received news today that Metrolinx and CAD have officially signed the deal awarding the 121 GO Transit Coach Refurbishment contract to the Montreal firm.

“The contract may be signed however we will never give up this fight to have the awarding of this contract to a Montreal company overturned by the Ontario Government”, said CAW Local 103 President Brian Kelly.

“Our members are furious that despite all Ontario Northland stakeholders’ coming together demanding that the contract be awarded to the ONR, this government went ahead anyways and approved the Metrolinx-CAD deal. It shows an ambivalence and lack of commitment towards all Northerners”, continued Kelly.

Ontario Government’s Offer of work to replace lost Metrolinx Deal is drop in the bucket

North Bay – Local MPP Monique Smith announced today that she had secured $10 Million in work on ONTC Polar Bear Express equipment. CAW Local 103 although appreciative of the work and Ms. Smith assistance says that it does not come even close to replacing the $120 million lost by the Metrolinx decision to award the GO Transit Refurbishment contract to Canadian Allied Diesel (CAD) of Montreal.

“This will not hinder our campaign to have the decision to award the Metrolinx contract to CAD overturned. We expect nothing less than full value the government response of providing $10 M for coach repairs to the Polar Bear fleet amount to 8.3% of the Metrolinx deal,”, stated CAW Local 103 President Brian Kelly.

“Although the government investing in rail coaches that services the James Bay region is a good thing, it is something this government should have been doing any ways and in no way replaces the work lost to Montreal or secures the 110 jobs in the ONTC Refurbishment Division.”, continued Kelly.

“We will continue the campaign and hopefully the Premier will finally listen to the citizens of Northern Ontario and step in and reverse this decision. Our Local and the communities our members live in believe that awarding the Metrolinx contract to the ONTC is the best value for public money and we challenge the Premier to come to North bay and convince 50,000 Northern taxpayers otherwise.”, concluded Kelly

Ontario Northland and the Canadian Auto Workers Ratify Five New Collective Agreements

Ontario Northland and the Canadian Auto Workers Local 103 are pleased to announce the ratification of five (5) new collective agreements. The union represents over 400 Ontario Northland employees including clerical, on board service, shop craft, hotel staff, as well as, stores and yard office staff, throughout Ontario Northland’s service territory. 73% of members voted in favour of the new contracts.

"These new agreements demonstrate the high level of commitment of both parties to work together through challenging times to sustain the organization for the future," stated Paul Goulet, President and Chief Executive Officer.

The contract, valid to December 31, 2013, provides a wage increase across all CAW agreements of 0.5% in year three plus a 1.5% maximum for cost of living allowance.

We are pleased that all five agreements have been ratified," said Brian Kelly, President of CAW Local 103. "The membership has shown strong support for our union and bargaining committee."

"We are very happy to have reached an agreement with the employees represented by the Canadian Auto Workers," said Corina Moore, Chief Operating Officer and lead negotiator. "The CAW membership understands the economic situation of Ontario Northland and is doing their part to ensure our success."

Notice to All CAW Local 103 Members

We are scheduled for bargaining conciliation with the ONTC and with the assistance of the Federal Conciliations Officer on May 17th to 19th in North Bay.

As per the Canada Labour Code the conciliation process is now formally over as of May 10th although we have agreed to still use the services of the conciliation officer. Since May 10th the bargaining process has entered the 21 day cooling off period after which time either party can set a strike or lockout deadline with 72 hours notice.

Based on the outcome of these meetings the Bargaining Committee may have to hold information meetings across the system to seek membership authorization to set a deadline to conclude negotiations.

Notice to All CAW Local 103 Members

The Agreement #12 (Shops) Bargaining Committee met with the Company on Monday April 18th at the Best Western Hotel in North Bay. Progress in resolving the outstanding contractual language issues were occurring at a very slow pace. Based on this the committee decided it would seek the assistance of the Federal Conciliator.

We are in the process of finalizing dates to meet the conciliator we will advice the membership once dates have been confirmed.

As per the Canada Labour Code the conciliation process is formally over May 10th but the services of the conciliator are still available. After May 10th the bargaining process enters the 21 day cooling off period after which either party can set a strike or lockout deadline with 72 hours notice.

We met with the company to discuss Agreement #5 (OBS) and #9 (Cochrane Station Inn) contract language issues at the Best Western Hotel in North Bay on February 3rd. Meeting was productive with only a couple of items moving to the main bargaining table as they dealt with monetary issues.

We have scheduled meetings February 8th and 10th at the Best Western Hotel in North Bay to discuss Agreement #1 (Clerical) contract language.

We also expect to hold meetings on Agreement #12 (Shops) contract language the following week. When dates are confirmed we will advise the membership.

CAW Information Bulletin

It has come to our attention that some of you still have not received the information regarding the upcoming voting process.

Please use the helpline number below if you do not have anything by Monday February 7, 2011, 1-877-495-6551.

As we predicted the Teamsters are continuing with their game of misinformation. Everything they say has been half truths or less. Let’s look at their record.

  1. False - CAW didn’t have the support to have a representation vote.

    Truth - majority of you signed CAW Cards and a vote is now being held.

  2. False – Teamster Campaign Committee are circulating a List of Teamsters supporters trying to show that they have a majority of you supporting them.

  3. Truth - We are receiving calls from CAW supporters saying their names are incorrectly on this list and are questioning the validity of the Teamster List. We know that the majority want real change and are supporting the CAW.

  4. The only group the Teamsters seem to have support from is in the ranks of management. Some temporary and full time supervisors have been lobbying you to support the Teamsters. You have to ask yourself one question, do you want to be represented by a union that has supervisors campaigning for them?

  5. False -The Teamsters are stating that your dues would be $200 a month per member. Truth - CAW union dues are based on the CAW Constitution which states dues are 2 hours and 20 minutes a month of your base pay. With their claim to be correct you would have to be making $85 an hour.

Over the next week the Teamsters will continue to bombard you with more of the same, only trying to confuse the real issue; “Bad Representation”.

Standing together you will fulfil your desire to have fair representation and become members of the CAW.

Notice to All CAW Local 103 Members

We met with the Company to discuss Agreement #1 grievances on January 19th in North Bay. All outstanding grievances were dealt with; the Unit Chair will give a briefing to the unit.

We also met on January 13th, 14th, 20th and 21st in North Bay to discuss Agreement #4 contract language issues and any outstanding grievances. Some good work was accomplished at these meetings but unfortunately there were still many unresolved issues. The Agreement #4 Bargaining Committee informed the Company on the 21st that all unresolved issues from these meeting would be moved to the main bargaining table when all units meet with the Company to discuss monetary demands and unresolved issues.

Meetings are schedule for February 1st, 2nd and 3rd in North Bay to discuss Agreement #5 and #9 contract language issues.

Meeting dates for Agreement #12 are still to be scheduled.

Notice to All CAW Local 103 Members

We met with the Company on December 7th to discuss Agreement #12 grievances and on December 9th for Agreement #5 grievances. Both meetings were held in North Bay. In each Agreement all grievances were discussed, and either were resolved or moved on to the bargaining table for further discussions. Each Unit chair will do a report within their respective Units detailing the outcomes of these discussions.

We have grievance meetings scheduled for January 11, 2011 in North Bay on Agreement #1 and Agreement #4 grievances.

Notice All CAW Local 103 Members

Greetings Members;

This week some of you may have begun receiving letters addressed to your homes from the U.S. based International Teamsters Union soliciting your support to join their union.

The Teamsters have sent this letter to you because of the current situation with their membership on the Maintenance of Way (M of Way) here at Ontario Northland.

As many of you may know the Maintenance of Way Employees here at Ontario Northland approached our Local with a request to change over to the CAW. They are looking for fair representation along with local autonomy in their dealings with Ontario Northland and told us they felt the best way to accomplish this was to join the CAW.

The Local CAW Executive brought the M of Way workers’ request (to welcome and encourage all M of Way members to sign cards to join the CAW) at our last Local meeting and the membership unanimously supported it.

There is large number of individuals within the Maintenance of Way group who have personally taken it upon themselves to talk to their co-workers to sign CAW cards and our Local has assisted these employees when needed. The campaign to join the CAW has been difficult for many Teamster members but they have persevered because they know their best chance for a better future at Ontario Northland is with the CAW.

Please bear with us while we continue our support of the M of Way workers as they move toward joining the CAW. Our advice is just to ignore the Teamsters letter and address any of your concerns to your Local leadership.

CAW Ratifies First Agreement with Brinks

June 15, 2010, 9:11 AM EST

CAW members at Brinks have ratified a first contract by 81 per cent in 13 locations across Ontario.

The 950 workers voted in the contract during ratification meetings over the last three days. 

The new contract includes improvements to wages and benefits, with the extension of health care benefits to retirees for the first time.

"These negotiations focused on protecting historic gains, such as the pension plan and building for the future, including greater job security and representation in the workplace," said CAW President Ken Lewenza. "We wanted to ensure that the work our members do at Brinks is fairly compensated and that they share in the success of the company."  

The deal also included a commitment by Brinks to create new full-time jobs and improved the scheduling of both full-time and part-time hours.

The deal was reached on June 11, 2010. The Brinks workers joined the CAW in October 2009.
